


Many listed buildings have been altered over time without the necessary consent, often by previous owners. Even where enforcement action is unlikely, missing listed building consent can cause problems when selling, remortgaging or refinancing.
I help owners review historic changes, understand their heritage impact, and prepare clear, evidence-based applications to regularise the position.
I was recommended by a local estate agent to help secure retrospective listed building consent for a Brighton seafront flat where unresolved consent issues were affecting a sale. The flat had been refurbished in 1993 without permission, and the lease plan appeared to show a staircase and internal window that raised heritage questions.
Through archive research and site investigation, I was able to show that the flat had been created, and the staircase most likely removed, before the building was listed in 1952. A hidden internal window was also uncovered behind sauna panelling. This evidence showed that the 1993 works had not harmed the listed building as it existed at the date of listing, and consent was granted. An updated lease plan was also provided to the solicitors to avoid confusion for the buyer.
The owners of this listed flat needed to regularise a rear extension that had long been used as a bedroom before improving and refurbishing it. A staged approach was taken, beginning with a Certificate of Lawfulness confirming the established residential use of the former outbuilding.
I then assessed which elements had changed since listing, their visibility, and their impact on the listed building, comparing them with similar alterations nearby. Retrospective listed building consent was granted, allowing the flat to be revalued and the owners to proceed with borrowing, redesign and renovation.
By analysing the existing layout, identifying surviving historic features, reviewing archive plans dating back to 1928, and comparing the flat with others in the same building, I was able to show that the current arrangement was acceptable in heritage terms. Retrospective listed building consent was granted, giving the owner a clearer position ahead of sale.
